    We are required by law to give you certain information "in writing" which means you are entitled to receive it on paper. However to allow you to access Electronic Services (as defined below), we must be able to (i) provide certain information to you electronically and (ii) to use electronic records and signatures in our relationships with you. So, in order to continue and use Electronic Services, you must review and consent to the terms outlined below. 


  1. Definitions

    Definitions: As used in this Consent, the terms below have the following meanings:

    • "Communications" means each disclosure, notice, agreement, fee schedule, statement, record, document or other information we provide to you or that you sign or submit or agree to at our request. Examples of such "Communications" include:
      • this Electronic Consent and any amendments;
      • our Mobile and Online Banking Services Agreement relating to Electronic Services and all amendments thereto;
      • all other Communications related to the Electronic Services or any Hancock Whitney product we provide to you either now or in the future; Policies and procedures (including our Privacy Policy);
      • periodic account statements and other information and notices about Bank Relationship or Online Service usage, maintenance, activity, transactions, fees, and charges, including periodic information that we must provide pursuant to Law;
      • all notices or disclosures regarding fees or assessments of any kind, including overdraft, over limit and returned item fees, as applicable;
      • notices of amendments to any of your Electronic Services agreements with us; and 
      • other disclosures and notices that we are legally required to provide to you, or choose to provide you in our discretion.
    • "Electronic Records" or "Electronic Communications" means an electronic or digital version of any Communication.
    • "Electronic Services" refers to each and every product and service we offer that you apply for, use, administer or access using an Internet website, email, messaging service (including, without limitation, SMS text messaging), and/or software applications (including, without limitation, those accessed via mobile or hand-held devices), either now or in the future.
    • "We," "us," and "our" refers to Hancock Whitney Bank.
    • "Hancock Whitney Product" means each and every account, product or service we offer that you apply for, use, administer or access, either now or in the future, including the Electronic Services.
    • "You" and "your" means the person giving this consent, and also each additional account owner, authorized signer, authorized representative and/or user identified on any Hancock Whitney Products that you apply for, use or access.
  2. Scope of Consent; Grant of Consent

    You consent and agree (1) to do or transact business, including electronic transactions, and to enter into contracts with us electronically; (2) to receive and to provide Electronic Records, and (3) to use electronic sounds, symbols, or processes as an electronic signature signifying your intent to be bound, all as we direct or require in our discretion in connection with any Hancock Whitney Product and your use of any Electronic Service.

    You agree that Electronic Records will be sufficient as "writings" under applicable law or regulation. Your consent to the receipt, provision, use and exchange of Electronic Records applies not only to the particular transaction with respect to which you are accepting this Consent, but also to all Electronic Communications that may be provided or made available to you regarding Hancock Whitney Products that you apply for, use, administer or access using our Electronic Services. At our option, the delivery of Electronic Records may begin immediately upon your acceptance of this Consent and without further action on your part. If, after accepting this Consent, you from time to time enroll in or obtain additional Electronic Services, you agree that it is not necessary for us to re-present or for you to re-accept terms like those within this Consent. If we do present you with such terms in connection with any Electronic Service in the future and you do not accept them, you agree that your decision not to accept the terms will not constitute a termination or rejection of this Electronic Consent with respect to any other Electronic Services.

  3. Method of Providing Communications to you in Electronic Form

    We will provide all Electronic Communications to you either (1) via email or SMS text; (2) by posting them to a web site that we will designate in an e-mail notice we send to you at the time the information is available; or (3) present them on-screen or for download through our Electronic Services; or (4) include them in other electronic Communications that we are delivering to you, or (5) in the manner specified in any other agreement that we have with you.

    To the extent permitted under applicable law, you agree when we send an Electronic Communication or notice of such a communication to you via email or SMS text to the last email address or mobile number, respectively, which you provided to us, we are presumed to have met our obligation to send, make available or otherwise furnish that Electronic Communication to you.

    If you do not consent to receive Communications electronically, you will not be able to use our Electronic Services to access your Account(s) via our website or transact other business with us electronically.

  4. Right to Receive Paper Copy

    You have the right to request a paper copy of Electronic Communications; we will not provide you with paper (non-electronic) copies of any Electronic Communication unless specifically requested by you. You may incur a fee for paper copies. You may request paper copies by calling us at 1-800-448-8812 or email or write to us at the address provided in the section titled "How to Contact Us" below.

  5. Updating Your Records

    It is your responsibility to provide us with a true, accurate and complete e-mail address, contact, and other information related to the Consent and your Electronic Services, and to maintain and update promptly any changes in this information. You can update information (such as your e-mail address) by calling us at 1-800-448-8812 or by contacting us using the contact information on our website.

  6. Hardware and Software Requirements

    Hardware and Software Requirements. In order to use our Electronic Services and to access, view and retain electronic Communications that we make available to you, you must have or obtain at your expense the following equipment and software:

    • A personal computer or other device that is capable of accessing the Internet and the required Internet connection. Your access to this page verifies that your system/device meets these requirements.
    • A current version of an internet browser such as Google Chrome®, Internet Explorer®, Safari®, and Mozilla Firefox®.
    • A current version of a program that accurately reads and displays PDF files used for Electronic Communications such as Adobe® Reader® which you can download for free at get.adobe.com/reader.
    • A printer, if you wish to print and retain records on paper.
    • Electronic storage such as a hard drive or other data storage unit if you wish to retain records in electronic form. 
    • A valid and active email address.

    "Current version" generally refers to the latest release of the software by its publisher and can include the version in effect immediately prior to the latest release if supported by its publisher. To learn more please visit our Systems Requirements web page.

    Please note that continuing to use our Electronic Services after receiving a notice of updates to our system requirements constitutes your acceptance and reaffirmation of this consent.
